General Conditions of Sale (GCS) for purchases made online at www.royalmodel.com

Royal Model owned by R. Reale, Via Eugenio Montale 19-95030 Pedara (CT) Italy, Tel:  39 (0) 95 7800 707, e-mail: customercare@royalmodel.com ("Royal Model") invites customers to read the following Conditions of Sale ("GTS') regarding the acquisition of products and the management of orders placed on our website.

On the website www.royalmodel.com. you can not only find “Royal Model Products” but also “Products from Royal Model Partners”

"Royal Model Product/s means all products offered onwww.royalmodel.com with the exception of those designated as products from Royal Model Partners.

"Products of Royal Model Partners" means all products offered on www.royalmodel.com  specifically designated as Products of Royal Model Partners.

 

1.Conclusione of the contract and delivery of products

1.1 Every order placed on www.royalmodel.com entails the conclusion of a contract of sale under Italian Law. When an order relates to a Royal Model product, it involves a single contract between the buyer and Royal Model, Via Eugenio Montale 19- 95030 Pedara (CT) ( "Royal Model"). When the order relates to a product of Royal Model Partners, it involves an additional contract with the respective Royal Model Partner. The name of the Royal Model Partner is specifically indicated on the product page of each particular product.

1.2 By clicking on the button "Add to Cart" the customer enters into a binding agreement in relation to the item(s) in the virtual shopping cart. Once the order has been sent, Royal Model will send the customer an order confirmation by e-mail within one hour(if you have not received it please check your SPAM folder). The purchase agreement is concluded between Royal Model and the client upon receipt of the order confirmation. If the customer does not receive any order confirmation within the period specified in clause. 1.2., the respective order shall be deemed as rejected by Royal Model and, therefore, void.

Orders in which the customer has opted for  advance payment will be shipped as soon as Royal Model receives full payment of the purchase price and any delivery charges. Please note, Royal Model requests all goods to be paid for within 7 days of the receipt of the order confirmation.

1.3 In cases where item(s) ordered are unavailable for reasons beyond the control of Royal Model, customers will be notified immediately. In such cases, Royal Model will be under no obligation to supply the item(s) ordered, except in circumstances where Royal Model has assumed the responsibility of supplying the item(s) in question.

In the eventuality, that an item(s) ordered should not be available; Royal Model will reimburse the client the full amount paid without any delay.

1.4 Royal Model does not assume the responsibility of having to search for other sources of item(s) which are not available. This provision also applies to orders to fungible goods (for item(s) which  only the type and characteristics of the products are described). Royal Model is only obliged to deliver  what is available in stock. If the delivery time is expressed in days, this only refers to working days, from Monday and Friday inclusive, excluding any public holidays.

5 Royal Model will in no way be held responsible for the non delivery, delay or loss of delivery packages due to the customer providing an incomplete or wrong address. When the respective package returns to our headquarters, it will be resent to the correct address and all delivery charges will be met by the customer.

2 Prices, shipping and express delivery charges

2.1 The customer is required to pay the price published on the product page when the order is sent . The price is final and includes VAT.

2.2 All delivery charges must be paid for by the customer, unless the customer opts for collection directly at Royal Model.

3.  Payment

3.1 Royal Model accepts different methods of payment including, credit card, bank transfer, PayPal and cash on delivery. Royal Model reserves the right to refuse certain methods of payment and may request different  methods of payment for certain orders.

3.2 When payment is made by credit card, the money will be simultaneously debited from the credit card at the moment the order is taken. Should the item(s) ordered become unavailable, Royal Model will refund the money by bank transfer or PayPal.

3.3 The buyer agrees to receive invoices, receipts and credit notes only in electronic format.

4. Right of withdrawal from Royal Model Products

The customer has the right to withdraw from any order relating to Royal Model item(s) without giving any reasons or providing any statements, as long as this is clearly communicated to Royal Model.

If customers wish to return a purchased item(s), you may use the label sent along with your order receipt or can print a new one from your customer account accessible on the Royal Model Website. If the customer does not have access to a printer, or encounters problems in downloading the label for the return or if you need a new label, please contact Customer Service (see the contact details indicated at bottom of the page) and request another. Customers are kindly reminded to use labels provided by Royal Model for any eventual returns in order to avoid unnecessary additional costs.

5. Right of Refunds from Royal Model

After completing the registration, customers can select one or more products they are considering to buy, placing them in the virtual "shopping cart", from where it is possible to review the item(s) before placing the order.

5.1 Information regarding the right of withdrawal (Art. 49, paragraph 1, lin. (H) of the Legislative Decree. N. 206/2005 "Consumer Code")

You have the right to withdraw from a contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day in which the customer or a third party, other than the carrier assigned to the respective customer, acquires physical possession of the last item ordered. In the event of a contract relating to multiple items ordered by the customer in one order and delivered separately, the 14 day period starts from the day in which the customer or a third party, other than the carrier assigned to the customer, acquires physical possession of the last item ordered.

To exercise the right of withdrawal, you must inform Royal Model, Via Eugenio Montale 19, 95030 Pedara (CT) Italy, Tel:  39 (0) 95 7800 707 Fax:  39 (0) 95 293 3770, e-mail:
customercare@royalmodel.com of the decision to withdraw from this contract by providing written notice (for example, by letter, e- mail or fax). It is possible, but not mandatory, to use the standard withdrawal form available here or use the standard statement as shown in point 6.3. If the customer decides not to use the standard withdrawal form attached, a letter must submitted clearly stating the intention to withdraw from the contract.

It is also possible to fill out and submit the standard withdrawal form electronically or any other unequivocal statement to that effect to Royal Model. In this case, Royal Model will immediately send confirmation of receipt of such withdrawal  through a reliable medium (eg by email). Customers are kindly requested to send any withdrawal request within the 14 day deadline, that is,
14 days after the day in which the customer or a third party, other than the carrier assigned to the respective customer, acquired physical possession of the last item ordered. In the event of a contract relating to multiple items ordered by the customer in one order and delivered separately, the 14 day period starts from the day in which the customer or a third party, other than the carrier assigned to the customer, acquired physical possession of the last item ordered.

5.2 Effects of withdrawal

Following the termination of the contract, Royal Model will reimburse any payments made by the customer, including delivery costs (except for any additional costs due to the customer choosing another delivery option, other than Royal Model standard delivery), without undue delay and in any event no later than 14 days from the day on which Royal Model is informed by the client about the decision to exercise the right of withdrawal. Any refunds will be made using the same means of payment used by the customer at the moment of purchase, unless otherwise stated. Customers will not incur any fees as a result of such reimbursement. The refund will be suspended until Royal Model receives the item(s) in question, or earlier, if the customer can provide proof that the item(s) have been posted.

The customer is required to return or deliver the item(s) without undue delay and in any case within 14 days from the day of the notification of the intention to withdraw from the purchase agreement.

Products must be returned:

 - properly packed in their original packaging, not ruined, damaged or soiled and with all components, instructions and leaflets;

 - including all postage documentation (present in the original packaging), in order to allow Royal Model to identify the customer (order number, name and address);

 - without manifest signs of use, except those associated with testing out a new acquisition (item(s) must not bear traces of prolonged use and should still be in a saleable condition).

We reserve the right to refuse a refund if the item(s) are not returned according to the conditions stated above.

The cost of returning item(s) is borne by the customer. Item(s) must be returned using the appropriate documentation supplied by Royal Model. The customer is liable for any diminished value of the item(s) as a result of careless usage of item(s) or usage beyond their functionality.

5.3 Standard Withdrawal Form

Customers intending to withdraw from a contract may use the standard withdrawal form available here , simply complete and send it to:

Customers also have the possibility to exercise the right to withdraw from the contract by sending an unequivocal letter to that effect using the following standard text

I hereby notify Royal Model of my intention to withdraw from the contract of the purchase of the following item(s):

- customer name

- customer address

- date

6. Right of withdrawal for Products of Royal Model Partners

 

The buyer has the right to withdraw from any order which concerns the Products of Royal Partners

6.1  Information regarding the right of withdrawal (Art. 49, paragraph 1, lin. (H) of the Legislative Decree. N. 206/2005 "Consumer Code")

You have the right to withdraw from a contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day in which the customer or a third party, other than the carrier assigned to the respective customer, acquires physical possession of the last item ordered. In the event of a contract relating to multiple items ordered by the customer in one order and delivered separately, the 14 day period starts from the day in which the customer or a third party, other than the carrier assigned to the customer, acquires physical possession of the last item ordered.

14 days after the day in which the customer or a third party, other than the carrier assigned to the respective customer, acquired physical possession of the last item ordered. In the event of a contract relating to multiple items ordered by the customer in one order and delivered separately, the 14 day period starts from the day in which the customer or a third party, other than the carrier assigned to the customer, acquired physical possession of the last item ordered.

6.2 Effects of withdrawal

Following the termination of this contract, Royal Model will reimburse all payments made by the purchaser, including the costs of delivery (except for any additional costs arising from the choice of a type of delivery other than the one offered by Royal Model standard delivery), with no undue delay and in any event no later than 14 days from the day when Royal Model is informed by the client of the decision to exercise the right of withdrawal. Any refunds will be made using the same means of payment used by the customer during the purchase, unless otherwise stated.
The customer is required to return or deliver the products without undue delay and in any case within 14 days from the day he announced his intention to withdraw from the purchase agreement.

Products must be returned:

- properly packed in their original packaging, not ruined, damaged or soiled and with all components, instructions and leaflets;

 - including all postage documentation (present in the original packaging), in order to allow Royal Model to identify the customer (order number, name and address);

 - without manifest signs of use, except those associated with testing out a new acquisition (item(s) must not bear traces of prolonged use and should still be in a saleable condition).

7. Refunds

Invoices will be issued in electronic format only.

7.1 Refunds are credited directly to bank accounts or by the payment method used at the time of purchase. For payments made by bank transfer, the refund will be paid into the account used for the original payment. For payments made via Paypal or credit card, the refund will be paid into the Paypal account or onto the credit card. For payments made by cash on delivery, the refund will be made to a bank account nominated by the client or if the order was paid for using a gift certificate, Royal Model will credit the refund to the customer account.

9. Warranty for defects and damaged items and additional information

9.1 The rules of the Consumer Code on warranty for damage and defects applies to all item(s) purchased from Royal Model. Customers are therefore entitled to their rights under Art. 130 of the Consumer Code and these rights must be exercised under the terms laid out in art. 132 of the Consumer Code.

9.2 These GCV are available on our website www.royalmodel.com and can be saved by using the feature on your internet service program (usually, File > Save As). You can also save and store them in PDF format by clicking here. In order to open the PDF files you must have Adobe Reader installed on your computer, which can be downloaded free from www.adobe.it or other similar programs.

9.3 You can store your order details and download the GCV by using the appropriate browser command to save the order summary that appears in the last screen of the purchasing process, or simply wait to receive your automated order confirmation message sent by Royal Model following the completion of the order. This confirmation message includes the details of the order and the GCS at Royal Model, and can easily be printed or saved using the functions provided by e-mail programs.

Applicable laws.

10.1 These GCS and purchase contracts are governed by Italian law and should be interpreted in this manner (in particular by the Consumer Code - in particular Articles. 46 to 67 governing distance contracts - and by Legislative Decree 70  from 09/04/2003 on electronic trade).

10.2 For any dispute arising in connection with  CGV and/or contracts of sale, customers can activate an out-of-court dispute resolution procedure which complies with the requirements laid out in Articles. 141 of the Consumer Code.
